Misleading property ads? Know your rights 🏠
If your home doesn’t match what was promised in brochures or ads, you may have up to 6 years to take legal action under the Limitation Act 1953 (Section 6).
Buyers misled by false statements can rely on:
- Contracts Act 1950 – Section 18 (what counts as misrepresentation)
- Limitation Act 1953 – Section 19 (right to void a contract induced by misrepresentation)
In a 2023 High Court case, buyers were awarded RM50,000 each, proving that brochures aren’t always “just marketing”.
👉 Key reminder: Always ensure all promises are written into the SPA.
